Terms and Conditions

1. USE OF THE SERVICE

1.1 - The customer undertakes to use this service in accordance with the laws and regulations in force that apply to him, as well as with the Terms and Conditions established herein.

1.2 - OASIPOR - MedicalWear S.A. may, at any time, change, in whole or in part, the Terms and Conditions established herein.

1.3 - The customer cannot change the content of the Service, send messages or files that contain computer viruses or cause other damages.

1.4 - Customers of the online store are considered final consumers, subject to VAT assessment, with the exception of third country residents, outside the European Union.

1.5 - The sale process is subject to compliance with the rules defined by Law no. 25/2008, of June 5, on the prevention and repression regime against the laundering of illegally derived advantages and the financing of terrorism.

2. PRODUCTS IN THE ONLINE STORE

2.1 - Products duly identified in the respective catalogs can be purchased online.

2.2 - The unavailability of any product in the online store does not mean that it is sold out at OASIPOR - MedicalWear S.A. and may be available in another distribution channel of the company.

2.3 - The purchase of products will only be accessible to registered users on the website.

3. PRICES

3.1 - The prices shown in the catalog are subject to VAT at the legal rate in force at the time of purchase, plus the respective shipping costs.

3.2 - The price of the products, the value of VAT and the shipping cost are duly detailed before the final phase of validation of the purchase.

3.3 - Any other costs resulting from sending orders abroad, in particular the costs of services and customs fees, will be the sole responsibility of the buyer of the product.

3.4 - OASIPOR - MedicalWear S.A. informs that the prices charged are exclusive to the OASIPOR - MedicalWear S.A. Online Store.

3.5 - OASIPOR - MedicalWear S.A. reserves the right to cancel orders in the event of an error in the product price. We will contact the customer to inform.

4. ORDERS

4.1 - The order of one or more products requires registration on the website.

4.2 - The order of a product, chosen from those existing in the product catalog, is made by placing it in the shopping cart.

4.3 - For some products, duly identified in the online store, the purchase can be limited to a certain number of units.

4.4 - The customer can cancel his order by sending the request to the email: encomendas@oasipor.pt, within 24 hours after the order confirmation by OASIPOR - MedicalWear S.A.

4.5 - The cancellation request will only take effect when the order number and the customer's name are indicated.

4.6 - The customer has the right to terminate the contract, returning the ordered items, without having to indicate the reason, within 14 days after delivery of the product, at no cost, being refunded by OASIPOR - MedicalWear SA of the total amount spent , except for the amounts provided for in the following paragraph.

4.7 - Whenever the customer expressly requests a different, personalized and more expensive form of delivery and terminates the contract, this difference will not be refunded.

4.8 - The right to free resolution may be exercised under the terms of paragraph 4.6, by physically returning the article and sending to the email address geral@oasipor.pt an unambiguous declaration of intention to return in which you must indicate: identification customer (name, geographical address and e-mail address); identification of the article, order number and date of receipt of the article, as well as the signature of the client, if this declaration is delivered on paper.

4.9 - OASIPOR - MedicalWear S.A. will bear the return postage costs, when the item is damaged or if there is an error in the shipment. In other situations, any return costs will be borne by the customer.

4.10 - OASIPOR - MedicalWear S.A. reserves the right not to accept sterile material that is not in the original and inviolate packaging.

5. PAYMENT METHODS

5.1 - Products can be paid for using the different electronic payment methods available, the costs of which are borne by the customer and charged to the sales document.

5.2 - For payments made through the "payment for purchases" or "payshop" system, OASIPOR - MedicalWear SA reserves the ordered product for 24 hours, after which, in case of non-confirmation of payment, the order may be canceled.

5.3 - The online store payment system is only available for purchases of € 5 or more.

6. DELIVERY TIME

6.1 - In mainland Portugal, orders are usually delivered within 2 to 5 working days after the date of payment.

6.2 - In the autonomous regions, depending on the islands, the delivery time can vary between 3 to 10 working days.

6.3 - Deliveries in Europe and the rest of the world vary according to the destination and time of transportation.

6.4 - Delivery of orders may, in specific cases, be delayed due to lack of stock.

7. RETURNS / EXCHANGES

7.1 - The delivery of products purchased in this service is in accordance with the legal rules applicable in Portugal to the exercise of distance selling (Decree-Law no. 24/2014, of 14 February, as amended by Law no. 47 / July 28, 2014).

7.2 - Only products whose original packaging has not been violated, which are in good condition and whose state of conservation and handling of the products was adequate will be accepted. Returns / exchanges of products whose expiration date has expired and which, at the time of delivery, was more than 1 year, will not be accepted.

7.3 - NON-CONFORMING PRODUCTS - The Customer has the right to return / exchange if it is found that the products supplied have non-conformities. The return / exchange can be made in a period to be agreed after the notification and analysis of the non-compliance. If non-conformity is confirmed as the reason for the total return (without exchange), the customer will be refunded the full amount paid by credit or debit note, to be agreed between the parties.

7.4 - ERROR IN ORDERING BY THE CUSTOMER - If the order of the wrong item has been placed, you must make the communication to the Commercial. Shipping and collection costs will be the responsibility of the Customer.

7.5 - ERROR ON SHIPPING - If you detect that an unsold item has been delivered, you must report it to the Commercial.

7.6 - TRANSPORT DAMAGE - If you detect any anomaly or damage caused by the transport of the ordered item, you must refuse and / or make the communication in writing on the carrier's guide and make the communication to the Commercial.

8. ONLINE STORE REGISTRATION

8.1 - Individual registration in the online store is done in «Register».

8.2 - This registration allows for an easier purchasing process, with the registration of the customer's identification data, allowing their immediate recognition, without the need for retyping.

8.3 - The Customer can update his personal information online whenever he makes a purchase in the online store.

8.4 - Access is restricted to each user and guaranteed by the use of a login and password that must be changed on first use.

8.5 - These data are sent to the customer's email to allow for their confidentiality, being the exclusive responsibility of the user for their subsequent use.

9. PRIVACY AND SECURITY POLICY

9.1 - OASIPOR - MedicalWear SA collects the client's personal data for the purposes of account management, collection, provision of information, in accordance with express authorization for that purpose, assuming the commitment of privacy and security in the processing and maintenance of personal data of each customer, under the terms of Law no. 67/98, of 26 October.

9.2 - The entire payment process, from the selection of payment methods to the introduction of the data inherent to the order payment process, is adequately protected with the appropriate electronic security tools.

10. APPLICABLE LAW AND COMPETENT FORUM

10.1 - Portuguese law is applicable to this agreement.

10.2 - For the resolution of disputes arising from this contract, the Center for Arbitration of Consumer Conflicts - Porto (CICAP) is competent, with express waiver of any other.
